6th Circ. Refers the hemp seed dispute to Ky’s court.


By Melissa Angell (September 20, 2021, 8:04 p.m. EDT) – The Sixth Circuit on Monday revived Legacy Hemp LLC’s contract lawsuit accusing Canadian hemp company Terramax Holdings Corp. demonstrated that Terramax had enough Kentucky ties to be sued there.

In a nine-page opinion, a three-judge panel concluded that a lower court erred in dismissing Legacy’s lawsuit because it did not meet personal jurisdiction requirements under the Law on Kentucky’s long arm. State law grants jurisdiction over out-of-state residents in certain circumstances.
